Our Contract with You

Your order is an offer to Ourmall.eu to buy the product(s) in your order. When you place an order to purchase a product from Ourmall.eu, we will send you an e-mail confirming receipt of your order and containing the details of your order (the “Order Confirmation E-mail”). The Order Confirmation E-mail is acknowledgement that we have received your order, and does not confirm acceptance of your offer to buy the product(s) ordered. We only accept your offer, and conclude the contract of sale for a product ordered by you, when we dispatch the product to you and send e-mail confirmation to you that we’ve dispatched the product to you (the “Dispatch Confirmation E-mail”).

Ourmall.eu, pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order.

Please take the time to check the details of your order at each page of the order process and before clicking “Confirm and Pay”, as you will not be able to make any changes to your order after this point.

Please note that items are subject to availability. As there is a delay between the time when the order is placed and the time when the order is processed, the stock position relating to particular items may change. If an Item becomes out of stock we will notify you as soon as possible and you will be refunded where we have already taken payment.

We reserve the right to refuse an order for example if the Item you have ordered is unavailable or out of stock, if we are unable to obtain authorisation of payment, if there is an error in the product information including price or promotion or if we suspect fraudulent activity.

If we are unable to supply you with an Item in these circumstances we will inform you of this by e-mail. If you have already paid for the Items, we will refund you the full amount as soon as possible.

You consent to receive sales invoices electronically. Electronic invoices will be made available in pdf format in the Your Account area of the web site. For each delivery, we will inform you in our Dispatch Confirmation E-mail if an electronic invoice is available.

The images of the Items on Ourmall.eu are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflect the colour of the Items. Your Items may vary slightly from those images.

All sizes and measurements of Items are approximate, however we do make every effort to ensure they are accurate as possible.

We take all reasonable care to ensure that all details, descriptions and prices of Items are as accurate as possible. We reserve the right to refuse orders where information about Items has been mis-published, including without limitation prices and promotions.

All our Items are sold on the basis that they are suitable for domestic use only. Please contact us for further information if you intend using any Items in a business or public environment.

We take all reasonable care to ensure that the prices of Items are correct at the time when the relevant information is entered onto the Sites.

Prices for Items may change from time to time without notice. However, these changes will not affect orders that have already been dispatched.

The price of an item includes VAT (or similar sales tax) (where applicable) at the prevailing rate for which we are responsible as a seller.

Please note that the prices listed on Ourmall.eu are only applicable for items purchased on our website and not through any other source.

Payment

You can pay for Items (including the Delivery Service) on Ourmall.eu using the following payment options:

B. You can make a bank transfer

C. You can pay by Revolut

We offer the “Verified by Visa” and “MasterCard SecureCode” service which provides you with a safer shopping experience when using your credit card online. You can register for the service when you reach the checkout process or by contacting your card issuer directly.. Please note, dependent on your card issuer we may not be able to process your order if you do not register and a different method of payment may be required to complete your purchase.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or does not for any reason, authorise payment then you will be notified as soon as possible.

The price of an Item does not include delivery and returns charges. You will be provided with details of our delivery charges during the order process. You can also see our delivery options and charges on our Delivery Details page. You can get information about charges for returning items if you choose to use one of our returns methods on our Returns Policy Information page.

All Items ordered remain our property until we receive full payment from you.

RIGHT OF CANCELLATION/RETURNS

CANCELLATIONS

No cancellation of order is accepted once the order is dispatched to you and you have received a courier trucking number.

RETURNS

Without prejudice to your statutory rights, Ourmall.eu provides you with the following voluntary returns guarantee:

All products from the ourmall.eu can be returned within 14 days of receipt of the products to courier if the products are complete and are in an unused and undamaged condition.

If you return products according to this voluntary returns guarantee, we will refund to you the purchase price already paid by you, but not the delivery costs of your initial purchaseYou will also need to bear the costs for returning the product back. unless we have sent you the wrong item. Wrong items are considered items you receive which are different from the ones you order(Different item/different size/different colour)You will need to log on into your account and fill the form Return Merchandise Form Once you fill this form and submit on line you need to print a copy of the receipt and place it together with the item you are returning. Then you need to go to your nearest courier’s station of ACS and give themthe parcel (together with the unique notification number and the name and address of the shop you are returning the product.

Conditions for accepting Returned items

If you change your mind about any items purchased you can return them to us (except grooming products, pierced jewellery or swimwear if the hygiene seal has been removed or any other item that cannot be returned for health or hygiene reasons) within 14 days of the order being delivered to you, provided:

1. The items are unworn and unwashed (and there are no signs of transfer of any make-up, or other stains)

2. If shoes, the items are unworn and show no signs of wear.

3. The Items have all tags attached and are returned with correct despatch and order information.

4. Sealed items remain sealed.

(“Wrong Items”)

Wrong items are only considered items that are different from the order you made:( Different Item /Different colour/different size) If you have received a different item from the one you order we will refund you the price that you paid for wrong Item you have received. You will need to complete the Return Merchandise Formand explain why the product you receive is different from what you order. The Refund will include any return delivery charges you have paid.

Steps to follow in order to return any items:

1. login into your account.

2. Under the section Customer Service Press Returns.

3. Fill all the required details explaining the reason you are returning the items.

4. Check your mailbox as you will receive a confirmation email containing the Return Material Authorisation (RMA) form and code, the courier to use and the address of the shop you are returning the product which must be printed and applied to the outside of the packaging of the products to be returned.

5. Go to your nearest courier’s station of ACS and give them the parcel (together with the unique notification number and the name and address of the shop you are returning the product.

6. Ask them to send the product to the shop referencing the ‘Return’ identification number using OURMALL.eu account. You will need to pay the Courier the amount of €1.90 (If you are entitled to be reimbursed with the delivery return cost it will be done at a later stage upon confirmation of the receival of the item by the shop).

7. You will need to follow the same procedure for every different shop you are returning an item. If you are returning more than one (1) item that belongs to the same shop then you need only to attach one bag containing all the items you are returning and you only need one (1) unique return number.

8. When the shop receives the returned products, we will effect the refund using the same means of payment used to make the purchase (credit card, prepaid card, PayPal, gift card etc) Refunds for returning delivery cost will be effected by crediting your account in form of gift card.

Pricing and Availability

All prices are inclusive of legally applicable VAT.

We list availability information for products sold by us on the website including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. As we process your order, we will inform you by e-mail as soon as possible if any products you order turn out to be unavailable and you will not be charged for those products.

Please note that unless otherwise stated on the website, delivery estimates are just that. They are not guaranteed delivery times and should not be relied upon as such.

Despite our best efforts, a small number of the items in our website may be mispriced. We will verify pricing when processing your order and before we take payment. If we have made a mistake and a product’s correct price is higher than the price on the website, we may either contact you before dispatch to request whether you want to buy the product at the correct price or cancel your order. If a product’s correct price is lower than our stated price, we will charge the lower amount and send you the product.

Service Access

While we endeavor to ensure that this Website is available 24 hours a day, we shall not be liable if for any reason this Website is unavailable at any time or for any period.

We give no warranties as to the availability, performance or accessibility of the Website.
